Men found guilty in kidnapping of gay man, but acquitted of hate crime
The jury verdict on Wednesday in Harlan County against David Jason Jenkins, 37, and Anthony Ray Jenkins, 20, stemmed from an April 2011 kidnapping of Kevin Pennington, 29, who managed to escape, according an indictment.
But jurors found both Anthony Ray Jenkins and his cousin David Jason Jenkins guilty on the charges of kidnapping and conspiracy to a kidnapping in connection with the assault on 29-year-old Kevin Pennington last year at a rural state park.
U.S. District Judge Gregory F. Van Tatenhove ruled Wednesday evening that the jurors could see the written transcript of 29-year-old Kevin Pennington reading from the statement during the trial. The written statement that Pennington gave the ranger was never entered into evidence.

Two Kentucky men plead not guilty in alleged gay hate crime beating
David Jason Jenkins, 37, and Anthony Ray Jenkins, 20, were indicted late Wednesday for allegedly kidnapping and beating Kevin Pennington. The defendants, who are cousins, also are charged with conspiracy.
